Terms of Use

These terms cover the i² Identity Index™ (athlete and leader versions), the results and emails it produces, and related Hearts & Minds assessments. By taking an assessment, you agree to them. Plain version: it's a coaching tool, not a diagnosis. Your answers are private, and we don't sell your information.

1. Ownership

The i² Identity Index™ (the "Assessment") is a proprietary instrument of Hearts & Minds. That includes its word bank, scoring methodology, paragraph templates, reflection questions, visual design, emails and supporting code. All content is © 2026 Hearts & Minds. All rights reserved.

2. Permitted use

You may take the Assessment for personal reflection and coaching. You may share your own results with family, coaches, mentors, counselors or therapists.

3. Prohibited use

Without express written permission from Hearts & Minds, you may not:

Reverse engineer, decompile or otherwise try to extract the Assessment's source code, word bank, scoring formulas or interpretive logic
Reproduce, republish, redistribute or commercially exploit the Assessment or any part of it
Create derivative works based on the Assessment
Administer the Assessment to others for commercial purposes
Remove or alter any copyright notice, trademark or proprietary label
Use automated tools to scrape or systematically collect Assessment content or response data

4. Not a clinical assessment

The Assessment is a coaching and reflection tool. It is not a clinical assessment, medical diagnosis or psychological evaluation. It has not been scientifically validated, and it is not a substitute for licensed mental health care or professional advice. 5. What we collect

When you take the Assessment we collect what you enter: your first name, email address, age, sex, country and state, and your word selections. Athletes also give sport and competition level, and athletes under 18 give a parent or guardian's email. Leaders also give role, industry, company size, years in leadership and whether they'd like a follow-up. The faith question is optional. If you arrive through a team, school, company or event link, we also record which group the link belongs to.

6. How we use it

To score your Assessment and send your results by email (and, for athletes under 18, a companion email to the parent or guardian you list)
To show your progress over time if you retake the Assessment. We keep each completion so we can compare them.
To follow up with you personally if you ask us to
To send occasional emails about Hearts & Minds programs. You can opt out at any time by replying or using the unsubscribe link.
To improve the Assessment, using combined results that don't identify you

7. Team, school, company and event links

If you take the Assessment through a link provided by your team, school, employer or an event, your results may be shared with the coach, leader or organizer who arranged it, individually or as part of a group summary. Group summaries used outside that organization (for example in Hearts & Minds research or case studies) never include names and never identify the organization without its permission.

8. Privacy and who processes your data

We don't sell your personal information. To run the Assessment we use trusted service providers that process data on our behalf, including Google (secure hosting, storage and email delivery) and HubSpot (our contact database). They may use your information only to provide those services to us. You can ask us to access, correct or delete your data at any time by emailing hello@hmperform.com.

9. Use by minors

The Assessment is designed for participants 13 and older. Participants under 18 should take it with a parent or guardian's awareness, and we ask for a parent or guardian's email so they receive a copy. The Assessment is not available to children under 13.

10. No warranty

The Assessment is provided "as is," without warranties of any kind. Hearts & Minds does not guarantee its accuracy, completeness or fitness for any particular purpose. Use it as a starting point for conversation and reflection, not as a measurement to make decisions from.

11. Limitation of liability

To the maximum extent permitted by law, Hearts & Minds is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Assessment.

12. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.

13. Changes to these terms

We may update these terms from time to time and will change the date at the top when we do. Continuing to use the Assessment after a change means you accept the updated terms.
